1. Acceptance of Terms

By accessing and using RahaTix ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Definitions

• "RahaTix" refers to the event ticketing platform operated by RahaTix Kenya
• "User" refers to any individual who accesses or uses the Platform
• "Event Organizer" refers to individuals or entities who create and manage events on the Platform
• "Ticket" refers to digital or physical passes for events sold through the Platform
• "Services" refers to all services provided by RahaTix including ticketing, payment processing, and event management

3. Use of the Platform

3.1 Eligibility

You must be at least 18 years old to use RahaTix. By using the Platform, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To access certain features of the Platform, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account

3.3 Prohibited Uses

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Transmit any harmful, offensive, or inappropriate content
• Impersonate any person or entity
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to any part of the Platform
• Use automated systems to access the Platform without permission

4. Ticket Purchases and Sales

4.1 Ticket Purchases

When you purchase tickets through RahaTix:

• You enter into a contract directly with the Event Organizer
• All ticket sales are final unless otherwise specified by the Event Organizer
• You are responsible for providing accurate information for ticket delivery
• Tickets are non-transferable unless explicitly allowed by the Event Organizer

4.2 Payment Processing

RahaTix processes payments on behalf of Event Organizers. By making a purchase, you agree to:

• Pay all charges associated with your purchase
• Provide valid payment information
• Accept that payment processing fees may apply

4.3 Refunds and Cancellations

Refund policies are determined by individual Event Organizers. RahaTix does not guarantee refunds but will facilitate refund requests according to the Event Organizer's policy.

5. Event Organizer Responsibilities

Event Organizers using RahaTix agree to:

• Provide accurate event information
• Honor all ticket sales made through the Platform
• Comply with all applicable laws and regulations
• Maintain appropriate insurance for their events
• Handle customer service issues related to their events

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The RahaTix Platform, including its content, features, and functionality, is owned by RahaTix Kenya and is protected by copyright, trademark, and other intellectual property laws.

8. Disclaimers and Limitations of Liability

8.1 Platform Availability

While we strive to maintain continuous service, RahaTix does not guarantee that the Platform will be available at all times or free from errors.

8.2 Event Responsibility

RahaTix is not responsible for:

• The quality, safety, or legality of events listed on the Platform
• Event cancellations, postponements, or changes
• Actions or omissions of Event Organizers
• Disputes between Users and Event Organizers

8.3 Limitation of Liability

To the maximum extent permitted by law, RahaTix's liability for any claims arising from your use of the Platform shall not exceed the amount you paid to RahaTix in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless RahaTix, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

10. Termination

RahaTix may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Kenyan courts.

12. Changes to Terms

RahaTix reserves the right to modify these Terms at any time. We will notify users of significant changes through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
